It has been more than 15 years since the U.S. Food and Drug Administration (FDA) approved Infuse Bone Grafts. At first, these artificial grafts were used only in spinal fusion procedures. Gradually, they were introduced for use in other procedures including the treatment of tibia fractures and in oral-maxillofacial surgery. Along with other devices, they have also been used to treat lower back ailments.

To date, more than 1 million people have had medical procedures featuring Infuse Bone Grafts. This meant that sales have increased accordingly and reportedly totaled approximately $750 million for just one year.

However, numerous complications, including infection, urinary issues and sterility have also been well documented over the years. Many patients suffering from these complications have pursued legal recourse.

If you have a pending Infuse Bone Graft lawsuit and you need money to cover medical costs or routine expenses while your case is pending, we may be able to help. Call us or fill out an online application to see if you qualify for financial relief in the form of Infuse settlement funding.

The Infuse litigation saga

In the past 11 years, more than 10,000 lawsuits against Medtronic (the maker of Infuse Bone Grafts) have been documented. Plaintiffs in these cases have alleged that they suffered serious complications associated with Infuse Bone Grafts including but not limited to increased pain, weakness, and spinal injuries. In some cases, plaintiffs said they needed additional surgeries.

Plaintiffs have also alleged that Medtronic pressured doctors to use Infuse Bone Grafts for conditions other than those it was approved for (off-label use).

The company has reportedly settled 4,000 lawsuits and in 2017 announced that it had set aside $300 million to cover future settlements. The anticipated cost of settling all of the lawsuits is more than $460 million.

Known side effects of Infuse Bone Grafts

As we have noted, the side effects of Infuse Bone Grafts have been well documented over the years. The known side effects include:

  • Male impotence
  • Inflammation
  • Heightened risk of cancer
  • Difficulty breathing
  • Paralysis or nerve damage
  • Infection
  • Bone tissue loss
  • Urinary difficulties

Some plaintiffs in Infuse Bone Graft lawsuits have claimed they needed additional surgical intervention to correct complications. In some cases, the families of patients who died also sued, claiming that their loved ones succumbed to side effects of Infuse Bone Grafts.

How much is my Infuse Bone Graft case worth?

Unfortunately, we are not able to answer this question. As with any other lawsuit, the amount a plaintiff can expect to recover depends on several factors which you should discuss with your lawyer. These include:

  • Why you had an Infuse Bone Graft
  • The severity of the side effects that you experienced
  • The extent of the treatment required for the side effects
  • Which settlement group you are in

Although Medtronic has settled past cases for significant amounts, there is no guarantee that you will receive similar compensation. There’s also no guarantee that your case will be settled quickly (see next section). However, we have a proven track record of providing financial relief for plaintiffs whose cases are pending. Contact us for an assessment of your case, today.

How soon can I get my Infuse Bone Graft settlement money?

Again, there is no simple answer to this question. Many civil lawsuits drag on for months or even years. There are many reasons for these delays. Sometimes it has to do with the case type and sometimes it has to do with court backlogs. Sometimes, insurance companies drag their feet hoping desperate plaintiffs will accept lesser settlements.

Unfortunately, this means that many plaintiffs face financial hardship while their cases are pending. If this has happened to you, we may be able to help.

Oasis provides pre-settlement funding, also known as consumer litigation funding, to its customers through different products depending on their state of residence or cause of action. Many consumers will be provided pre-settlement funding in the form of a purchase agreement, which assigns a portion of the pending proceeds from their legal claim.  Other consumers, such as those in CO, IL, MN, MO, SC, WI and some OK residents, will be offered a funding in the form of a pre-settlement loan, sometimes referred to as a lawsuit loan. These transactions have important differences, therefore, consumers should carefully review and be aware of the type of transaction that is offered to them by any funding company.
